INTRODUCTORY LOCAL LAW

ASSUMPTION OF DUTIES OF VILLAGE MANAGER

 

 

BE IT ENACTED by the Board of Trustees of the Village of Walden, County of Orange, State of New York, as follows:

 

Section 1. Chapter 56, titled “Manager” of the Code of the Village of Walden is amended by adding a new §56-5 to read as follows:

 

§56-5. Assumption of duties of the Village Manager

 

In the event that the Village Manager is unable to perform the responsibilities or duties of the position due to being incapacitated, being placed on medical or administrative leave or for any other reason, and there is no Deputy Village Manager, the Mayor, Deputy Mayor, any Trustee, any Appointed Officer and/or any Department Head shall be designated by the Board of Trustees to assume and carry out the responsibilities and duties of the Village Manager in accordance with the state Village Law and this chapter until such time as the Village Manager is able to perform such duties and responsibilities or another person is appointed Village Manager by the Board of Trustees. The designated officer shall have the authority to delegate such duties and responsibilities.

 

Section 2. Supersession. To the extent that any provisions of the state Village Law or of any special law are inconsistent with this local law, such provisions are hereby superseded.

 

Section 3. This local law shall take effect immediately upon filing with the Secretary of State.
