VILLAGE OF WALDEN

INTRODUCTORY LOCAL LAW

RESIDENCY OF CERTAIN OFFICERS AND EMPLOYEES

 

 

BE IT ENACTED by the Board of Trustees of the Village of Walden, County of Orange, State of New York, as follows:

 

Section 1. Section 1 of Chapter 63, titled “Officers and Employees” of the Code of the Village of Walden titled “Eligibility for office; residence” is amended by amending subsections A and C to read as follows:

 

A. A person shall be eligible to be appointed as an officer of the Village or as the Village Manager, provided such person is a citizen of the United States; is at least 18 years of age; maintains a residence in and is a resident of the County of Orange and, provided further, that if eligibility for holding of such office is subject to regulation under Civil Service Law that the person meets the requirements of such law.

 

C. This section shall not apply to the position of Mayor, Trustee or member of the Planning Board and Zoning Board of Appeals, all of which positions shall be filled by persons who are citizens of the United States; over the age of 18 years; and who maintain a residence in and are residents of the Village of Walden.

 

Section 2. Authority. This local law is adopted pursuant to Municipal Home Rule Law §10(1)(ii)(a)(1), which permits the Village to amend or supersede the State Village law with respect to its own property, affairs, or government as it relates to the powers, duties, qualifications, number, mode of selection and removal, terms of office, compensation, hours of work, protection, welfare and safety of its officers and employees.

 

Section 3. Supersession. To the extent that any provisions of the state Village Law or of any special law are inconsistent with this local law, such provisions are hereby superseded

 

Section 4. This local law shall take effect immediately upon filing with the Secretary of State.
